These Terms of Use (“Terms”) govern your use of HoldTHISandTHAT, a service operated by KBDev Studio (“HoldTHISandTHAT,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.
Accounts
You must provide accurate account information and keep your login credentials secure. You are responsible for activity performed through your account unless caused by our failure to use reasonable security measures. Usernames may be permanent or subject to restrictions described in the Service.
Beta service
HoldTHISandTHAT may be offered as a beta or pre-release service. During beta, features may change, be added, be removed, or occasionally fail. We may make changes needed to improve reliability, security, or functionality.
Your content
You retain ownership of content you submit to HoldTHISandTHAT. You give us a limited license to host, store, transmit, reproduce, and process that content only as reasonably necessary to provide, secure, maintain, and improve the Service and to perform features you request.
You are responsible for ensuring that you have the right to upload or store the content you submit.
AI features
Some features use artificial intelligence to interpret, transcribe, classify, organize, summarize, or otherwise process content. AI output can be incomplete or incorrect. You are responsible for reviewing information before relying on it for important personal, professional, financial, legal, medical, or other decisions.
Trials and subscriptions
HoldTHISandTHAT may offer free trials, promotional pricing, tester pricing, monthly plans, annual plans, or other subscription options. Current pricing and renewal terms will be shown before you purchase. A free trial does not require payment unless the checkout flow specifically states otherwise.
If you choose a paid subscription, you authorize our payment processor to charge the applicable subscription price and taxes according to the terms shown at checkout. Subscriptions renew automatically unless canceled before the renewal date, unless the checkout terms state otherwise.
Promotional or tester pricing may remain available only while the qualifying subscription stays continuously active. If a qualifying subscription is canceled or expires, the same promotional rate may not be available if the user later resubscribes.
Cancellation and account deletion
You may cancel a paid subscription using the billing controls provided by the Service or payment processor. Cancellation stops future renewals but does not automatically delete your HoldTHISandTHAT account or content. You may separately delete your account using the account controls provided by the Service.
Acceptable use
You may not use HoldTHISandTHAT to violate law, infringe the rights of others, interfere with or damage the Service, attempt unauthorized access, distribute malware, abuse automated systems, or use the Service in a way that materially harms other users or our infrastructure.
Service availability
We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free availability. Internet access, third-party services, device capabilities, and maintenance may affect availability. Features such as reminders and notifications should not be used as the sole method for time-critical or safety-critical obligations.
Changes to the Service or Terms
We may modify the Service and these Terms. If a change is material, we will provide reasonable notice through the Service or another appropriate method. Continued use after updated Terms take effect constitutes acceptance of the updated Terms.
Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, noninfringement, or uninterrupted availability.
Limitation of liability
To the maximum extent permitted by law, KBDev Studio and its affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from or related to your use of the Service. Any limitation that cannot legally apply in your jurisdiction will apply only to the extent permitted by law.
Termination
We may suspend or terminate access when reasonably necessary to address fraud, security threats, legal requirements, material violations of these Terms, or nonpayment. You may stop using the Service and delete your account at any time, subject to any separate subscription obligations already incurred.
Governing law
These Terms are governed by the laws applicable to KBDev Studio’s principal place of business, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
